When recovering debts through arbitration proves impossible, we, having obtained the Client’s consent in the form of a power of attorney ad litem, submit the matter to the court. At that stage we prepare and gather the necessary documents, ensuring that their subject matter and legal accuracy, which is followed by drafting of a statement of claim in proceedings by writ of payment. After the writ of payment becomes enforceable, we apply to a court of competent jurisdiction to issue enforcement clause. In particularly complex cases we can represent the Client under the usual procedure (which entails representation of the party by a legal advisor during court hearings, submitting evidence and preparing statements of claim), up and until the court order is obtained and the enforcement clause attached. However this scope of services is covered by a separately signed agreement. We also provide legal representation in matters falling within the scope of the composition and bankruptcy law. Legal representation services include: representing the interest of parties to a proceedings, filing motions for bankruptcy of a debtor, submitting claims, preparing motions for opening of composition proceedings on behalf of the debtor, supervising the implementation of the composition on behalf of the creditor.
