Supporting the activities of the court enforcement officer and supervising the enforcement proceedings
The objective of supporting the activities of the court enforcement officer is to repeat the attempt to recover the debt through voluntary negotiations with the debtor. Within the scope of the support activities we send to the debtor a request for payment, negotiate the form and date of payment of amounts due, together with interest, court fees and costs of legal representation, to the benefit of our Client. Before initiating the enforcement proceedings proper, we send to the debtor a final pre-enforcement notice requesting immediate payment of the amounts due to the Client, under the pain of commencement of immediate collection by the court enforcement officer. The enforcement proceedings are initiated by us by submitting the motion to an appropriate court enforcement officer, with the indication of the manner in which the enforcement proceedings are to be executed. Within the scope of the agreement for supporting the activities of the court enforcement officer, we also ensure proper manner of the proceedings, determine and inform the court enforcement officer about the debtor’s assets that can be seized. Where immediate action is advisable in order to secure the debtor’s assets for future enforcement, we propose that our Clients obtain injunction – even the enforcement clause is obtained. As a result of successful enforcement the Client recovers the entire debt amount, as well as the court fee and the upfront fee for the court enforcement officer. In the event the debtor is insolvent, we obtain the court enforcement officer’s confirmation that the enforcement proceedings proved ineffective, which allows for writing off the debt as non-collectible, and charging it as business costs.
